Automation and Artificial Intelligence Plan

With strong leadership from the Governor’s Office, Nevada can make proper use of new technology, including automation and artificial intelligence (AI), while ensuring the safety of residents, workers and visitors navigating the current landscape.

To date, the State of Nevada has failed to systematically oversee the rapid adoption and evolution of these technologies that has occurred throughout the 2020s. Current leadership has been more interested in protecting corporate profits that siphon money out of the state than in protecting the safety of Nevadans with proactive and transparent oversight of these technologies..

But with clear guidelines and partnerships with public and private organizations, Nevada can lead the way forward — safely.

Autonomous Vehicles

Self-driving vehicles, including automated trucks, are increasingly prevalent on our nation’s roadways. However, the federal government has failed to enact any safety oversight of these vehicles or consider the impacts of autonomous vehicles on the existing workforce. State lawmakers have the ability to stand up for public safety and protect the jobs of thousands of working people by supporting responsible legislation that governs the future deployment of autonomous vehicles. Safety and protections for workers need to be prioritized when implementing any new technologies. 

Commercial Vehicles

  • Executive Order: Require human drivers in all commercial vehicles, tests, and transportation systems; waivers will no longer be issued.
  • 1st Session: Codify clear safety standards for the testing or use of any autonomous driving system.
  • 1st Session: Require state permitting and approval of any transportation system which utilizes autonomous vehicles. 
  • 1st Session: Create a specific workforce development and retraining program for workers who may be impacted by autonomous vehicles in the future.

Rail Safety

  • Executive Order: Review all utilized automated track inspection technologies and establish clear safety standards to ensure appropriate human oversight. 
  • Executive Order: Review all utilized automated operational control systems that exercise greater control over a locomotive and establish clear safety standards to ensure appropriate human oversight.
  • 1st Session: Ensure railroaders are not unsafely replaced by technologies which are meant to be complementary to their job functions. 

Automated Decision-Making Technology (“ADMT”) 

The State of Nevada needs to systematically clarify the application of new and emerging technologies that make decisions or facilitate human decision making (“Automated Decision System”). While these systems offer advantages to enhance decisions, lack of oversight by the state has allowed corporations to take advantage of consumers and erode protections against anti-discrimination, fair adjudication, workplace safety, and social media fairness.

Consumers 

  • Executive Order: Review and update ADMT regulations for all boards and commissions that oversee financial or lending services, education, employment, and healthcare.
  • 1st Session: Require all regulatory boards and commissions to adopt minimum standards for any use of ADMT.
  • 1st Session: Update fines and criminal liability for the use of ADMT to defraud or deceive consumers.

Hearings or Adjudicative Processes

  • Executive Order: Prevent any denial of benefits or ruling against a claimant by an ADMT process. Ensure human review and decision making.
  • Executive Order: Require all state agencies that utilize generative AI to directly communicate with a person regarding government services and benefits and ensure that those communications include both (1) a disclaimer that indicates to the person that the communication was generated by generative artificial intelligence and (2) an explanation of the process to contact a human employee of the state agency.
  • 1st Session: Require all adjudicative processes to implement standard ADMT policies which ensure human oversight on any decision.
  • 1st Session: Establish a procedure for all adjudicative processes to utilize ADMT to ensure transparency, fairness, and investigation of abuses of authority.

Workplace Safety

  • Executive Order: Review and update ADMT regulations for Nevada Mechanical Compliance Section (MCS), Occupational Safety and Health Administration (OSHA), and Mine Safety and Training Section (MSATS).
  • 1st Session: Establish minimum standards for use of any ADMT by Nevada MCS, OSHA, and MSATS.

Social Media

  • Executive Order: Require an AI watermark on all social media content created with AI. 
  • 1st Session: Require all social media platforms provide transparency and opt-out options to users on use of ADMT applications.
  • 1st Session: Require all social media platforms provide a reasonably accessible mechanism to Nevada users to report to the social media platform any sexually explicit image or video of them posted on that platform that was created or altered through digitization without their consent (i.e., “sexually explicit digital identity theft”).
  • 1st Session: Require the block and removal of any covered material on the social media platform while reported material is investigated and once the platform determines there is a reasonable basis to believe the reported material is sexually explicit digital identity theft.
